True or False?
Updated: Aug 19
THE ANSWER?… IT DEPENDS!
Yes, you can potentially dismiss an employee during their probationary period if they’re not suitable for the role — but probation is not a free pass to dismiss someone for any reason.
Even during probation, employees have important legal protections. Depending on the circumstances, dismissing someone could potentially lead to an Employment Tribunal claim — for example involving discrimination, whistleblowing or an automatically unfair reason for dismissal.
The reason matters. The process matters. Their legal rights still matter. Notice and contractual requirements must also be considered.
So before saying “they’re just not the right fit”, make sure you know WHY — and take advice before you act.
That’s why HR isn't always as simple as TRUE or FALSE!
